PARTICIPANT AGREEMENT, RELEASE AND ACKNOWLEDGMENT OF RISK

In consideration of participation in yoga instruction and related activities offered by Limberva LC, a Virginia limited liability company, doing business as LIMBERVA (“Limberva”), including its owners, instructors, employees, volunteers, agents, and representatives, I agree as follows:

1. Acknowledgment of Risk

I understand that participation in yoga involves inherent and unforeseeable risks, including but not limited to physical injury, emotional distress, illness, paralysis, or death, as well as damage to personal property. These risks cannot be completely eliminated without altering the essential nature of the activity.

Risks may include, among other things: muscle strains or tears, joint injuries, fractures, bruising, nerve irritation, dizziness, or other physical or psychological effects arising from physical exertion, breath practices, my own health condition, or limitations unknown to Limberva.

I further acknowledge that instructors may not be aware of my individual medical history or physical capabilities, may give incomplete instructions, or that props or facilities may be improperly used, worn, or fail.

2. Assumption of Risk

I knowingly, voluntarily, and expressly assume all risks associated with my participation. I understand that yoga is not medical treatment and that I am responsible for monitoring my own condition during practice.

3. Release & Waiver of Liability

I hereby release, waive, discharge, and covenant not to sue Limberva from any and all claims, demands, or causes of action arising out of or related to my participation, including claims based on the negligent acts or omissions of Limberva, to the fullest extent permitted by Virginia law.

4. Indemnification

I agree to indemnify and hold harmless Limberva from any claims, costs, damages, or expenses, including reasonable attorney’s fees, arising from my participation or my breach of this agreement.

5. Insurance & Health Representation

I certify that I have adequate health insurance or the financial ability to cover any injury I may sustain. I further acknowledge that I am responsible for consulting a medical professional regarding my fitness for participation and assume all risks related to any known or unknown medical conditions.

6. Governing Law & Venue

Any dispute shall be governed by the laws of the Commonwealth of Virginia and brought exclusively in a court of competent jurisdiction within Virginia. If any provision of this agreement is found unenforceable, the remaining provisions shall remain in effect.

7. Photography, Video & Media Release

Limberva occasionally documents classes and workshops for educational and promotional purposes. By participating, I consent to the use of photographs or video in which I may appear, unless I notify the instructor in advance that I prefer not to be included.

By signing electronically below, I acknowledge that I have read this agreement in its entirety, understand its terms, and voluntarily agree to be bound by it. I understand that I may be waiving legal rights, including the right to sue.
